Gulf-front Orange Beach: dunes, walkovers and the Coastal Construction Line

A new seawall on the Gulf beach in Orange Beach is close to banned. The rules favor dunes, walkovers and sand over walls, and they add lighting and wildlife limits. This guide covers the beach, not the canals, which have their own pages.

The City of Orange Beach holds the Gulf front from near longitude -87.636, the Gulf Shores line, east through Romar Beach and Alabama Point. Across the pass its polygon continues along Perdido Key to about -87.514. Little Lake and Middle River sit behind the dunes at Romar Beach. Gulf State Park runs four public accesses here: Romar Beach, Cotton Bayou, Alabama Point East and Shell Beach. They are state land inside the city.

Line, dune, light and sand: the four things that govern the beach

On the Gulf front, the question is rarely how to build a wall. It is what you may build at all. Four layers answer that: the Coastal Construction Line (CCL), the dune rules, wildlife lighting and the engineered beach.

The Coastal Construction Line and who enforces it

The CCL is a mapped line set by state plane coordinates. Between it and the water, the state bars new structures. ADEM's rule prohibits removing primary dune sand or vegetation, building any new structure, or substantially improving an existing one between mean high tide and the line. ADEM beach rule Mean high tide is the average high-tide mark.

A permit is needed for a parcel the line crosses. That includes gazebos and dune walkovers, not only houses and walls. ADEM coastal permitting page The state has handed the day-to-day work to the city. ADEM says Orange Beach, Gulf Shores, Dauphin Island and the county run permitting, monitoring and enforcement for Gulf-front work. ADEM delegation notice Your first call is the city's Coastal Resources office.

The city code goes further. It bars any new structure between the line and a point 1,500 linear feet seaward of the Gulf shoreline. The exceptions are dune walkovers, sand fencing and certain piers. City coastal construction code A surveyor must show the line from state plane coordinates and the distance to the nearest CCL monument. ADEM beach rule

Why a Gulf-front wall is close to a ban

State rules allow a wall on a Gulf beach or primary dune only if it sits landward of the line. It must be necessary to protect an existing or permitted structure, and no workable non-structural option, including retreat, may exist. ADEM beach rule The city adds more tests: public access must stay open, and the wall may not harm neighbors. City coastal construction code

The survey must mark the line and mean high tide.

Do not trust one fee figure. An older ADEM application form still prints $700 for a wall. ADEM Form 328 Ask Coastal Resources which fees apply to your file before you budget.

Seaward of the line, the zoning code bars protective shoreline structures unless the Board of Adjustment, the Corps and ADEM approve a variance. It also sets design criteria. The structure must run the full length of the lot, with return walls tied into the upland. It must use a sloping revetment or toe protection, and have drainage with weepholes. City zoning ordinance The only height rule is that the top should match projected wave run-up, with no number given. City zoning ordinance See seawall height requirements and the Gulf-front armoring guide.

Dune walkovers and dune protection

A walkover is the normal way to cross a dune. ADEM defines one as a raised walkway no wider than six feet, with no roof or walls, at least one foot above the dune. ADEM beach rule The city's dune walkover permit costs $50. City fee schedule The Perdido Key habitat permit requires elevated walkovers on Gulf-front lots. Permit site measures

The city also bars man-made alteration of dunes in its flood zones where it would increase flood damage. Minor grading is limited to one to two feet of compatible soil unless an engineer shows no harm. City flood ordinance Sand fencing, dune modification and windblown sand removal each need ADEM or Corps permits. Habitat permit terms

Sea turtle and nesting bird season

Sea turtle nesting season runs May 1 to October 31. In the Beach Overlay District the wildlife-friendly lighting ordinance sets strict limits. Lights on piers over the beach must be long wavelength, shielded and under 42 inches above the deck. Walkovers and beach access points get no lights. Construction lighting in season is limited to 6 a.m. to 9 p.m. and mounted under eight feet. City wildlife lighting ordinance

Plan any dune or beach work outside nesting months where you can.

East of the pass: Perdido Key beach mouse rules

Federal critical habitat for the Perdido Key beach mouse includes 115 acres of Gulf State Park land and 33 acres of private land in Baldwin County. Federal critical habitat rule Federal critical habitat rule The city holds a 30-year federal take permit covering 73.744 acres, effective 2021 to 2051. Fish and Wildlife permit summary

Projects in that zone must follow set terms. Permit site measures

  • Shield and aim outdoor lights downward and away from the beach.
  • Tint windows and glass doors to pass only 45% of light.
  • Set silt fence 25 feet beyond the building footprint and 4 inches off the ground.
  • Keep a natural vegetated corridor at least 10 feet wide on every side of the parcel.

Mitigation money applies too. The permit requires $100,000 per acre for permanent impact to habitat, and annual $201 payments per condo unit, per bedroom for homes or per commercial parking space. Habitat permit payments

The beach is engineered, and it needs upkeep

A 15.3-mile restoration with 7.9 million cubic yards of sand was built in 2005 and 2006. Olsen beach report The latest joint renourishment called for about 2,035,000 cubic yards along roughly 81,000 feet of shoreline. Renourishment bid notice In January 2024 the city's coastal director said about 650,000 yards would go on Orange Beach. The director also said that periodic renourishment keeps the FEMA engineered beach status that allows cost sharing. ADCNR article

A dune or walkover that fits today's wide beach was designed on added sand. Plan for a narrower beach in a few years. Ivan in 2004 showed the risk: waves scoured sand from under foundations, and some buildings collapsed. NHC Ivan report Sally's damage was lighter on the Gulf-facing beaches. NWS Sally county report

Condo boards face extra studies

A condo or multi-unit project on a CCL parcel must file an Environmental Impact and Natural Hazards Study and a Beach and Dune Enhancement Plan. ADEM beach rule The city's flood ordinance requires the lowest structural member in V zones to sit three feet above base flood elevation. City flood ordinance Coastal V-zone base elevations on the county maps run from 10 to 18 feet. FEMA county flood maps Boards should read the condo seawall repair page.

What could the work cost?

Budget for studies before construction on the Gulf front. Survey, engineer letter, alternatives analysis, two fees and wildlife measures can add up before any wall or walkover is priced. Ask each bidder to separate permitting support from construction. Perdido Key lots also carry the annual habitat payment. See the cost guide for typical ranges.

Orange Beach permit values are what applicants declared for fee purposes, not invoices. Public bids carry bonding and county terms. Prices for steel, concrete, composite and aluminum come from outside Alabama and are labeled with their geography.
