Seawall Checks for Realtors in Orange Beach, Alabama
In Alabama the buyer carries most of the bulkhead risk, so the best help you can give is a clear question asked before closing.
Why does the bulkhead question land on the buyer?
Alabama treats a resale home as buyer beware. The Alabama Real Estate Commission says no warranty comes with a used home. Neither the seller nor the agents must volunteer defects unless asked, except those that pose an immediate health or safety risk. They also may not misrepresent a condition they are asked about. Alabama Real Estate Commission
A Baldwin County case shows how this plays out. In Kidd v. Benson (2020), a Fish River bluff and part of a bulkhead and boathouse collapsed months after the sale. The buyers had signed an as-is contract and had not inspected, and the sellers won. Kidd v. Benson
An as-is clause plus no inspection can end a claim before it starts. Put the bulkhead, dock and boathouse in the inspection list while the contract still allows it.
Where do I find the permit history?
Start with the parcel. Baldwin County permits the unincorporated areas plus the Towns of Elberta, Magnolia Springs and Perdido Beach. Other cities permit inside their own limits. If nothing turns up, file an Alabama public records request. Offices must acknowledge a standard request within 10 days and answer within 15 business days of that. Alabama Open Records Act
What should I send the marine specialist?
Send one short package so the answer fits the decision:
- The exact question: is the wall sound, what would repair cost, or what would replacement need?
- Parcel number, survey, past permits and any invoices or photos, with gaps marked as gaps.
- Who can open gates and dock access, and the date any inspection deadline ends.
Ask who holds which license. Alabama requires a Home Builders Licensure Board license for residential work above $10,000, and a General Contractors Board license for work of $100,000 or more. Code of Alabama 34-14A-2 Code of Alabama 34-8-1 See the seawall assessment guide for what a visit covers.
What to ask for in a seawall condition report
Confirm the type of assessment and written report with the professional you choose, including the scope and delivery date. Ask for dated photos, findings, recommended repairs and a list of areas that could not be inspected.
Ask whether the assessment covers the wall panels, concrete cap, joints, supports and ground behind the wall. Buried anchors and underwater areas may need extra investigation. If you need a repair budget or an estimate of remaining life, discuss that before the visit.
Request report pricing. Confirm the scope, price and availability directly with the professional before relying on a visit or report date.
See the InterNACHI waterfront inspection standard for examples of what a visual inspection covers.

Common questions
Do I have to disclose a bulkhead problem I know about?
Not as a general rule, but you must not misrepresent a condition when someone asks. Alabama also carves out defects that threaten health or safety and are not readily visible. When in doubt, tell your client to ask the seller in writing. Alabama Real Estate Commission
Is a dock or boathouse treated the same as the bulkhead?
In Kidd v. Benson the bulkhead wall and the boathouse failed together, and the buyers could not recover. List the dock, lift, boathouse and wall as separate items in the inspection request. Kidd v. Benson
Can I tell clients what repairs will cost?
No. Cost belongs in a written scope from a qualified marine contractor. You can point them to the cost guide to learn what a complete scope lists.
What if the seller says the wall work was preventive?
In Kidd v. Benson the sellers called the bluff work preventive, and the buyers never had it inspected. The court still found for the sellers because of the as-is clause. Kidd v. Benson, the "preventive" answer
Does a flood policy cover the bulkhead?
No. The standard federal flood policy does not insure seawalls, bulkheads, docks or piers, so repairs usually fall on the owner. NFIP policy form
What if a wall looks unsafe at a showing?
Keep people back from the edge and tell the listing agent and owner the same day. If anyone is in immediate danger, call 911.
Where do I find the bulkhead permit history?

Yes. ADEM requires authorization before building a new structure, or substantially improving an existing one, on a parcel touching or seaward of the Coastal Construction Line (CCL). That includes hardened erosion control structures. ADEM coastal permitting

A Gulf-front wall is a coastal permit question, not a simple repair. See the Gulf-front armoring guide.
