Does flood insurance cover my bulkhead?

Usually not. The standard NFIP flood policy does not insure seawalls, bulkheads, wharves, piers or docks. A bulkhead is mostly a self-insured asset. SFIP Dwelling Form

The same form excludes boathouses and any building located entirely over water or seaward of mean high tide. SFIP Dwelling Form Read the exclusions before you assume a policy pays for a damaged wall, dock or lift.

Policy language varies, so ask your agent in writing what your homeowners, wind and flood policies say about retaining walls, bulkheads, docks and landscaping. Keep the reply with your wall records. An assessment gives you a baseline.

What are the wind pool and named-storm deductibles?

The Alabama Insurance Underwriting Association is the coastal wind pool. It covers eligible property south of the 31st parallel in Baldwin and Mobile counties for owners who cannot get coverage in the standard market. AIUA Property in flood zones A and V is ineligible unless flood insurance is in force. AIUA rules

AIUA stops writing policies once a named storm enters its watch area or a tropical storm watch or warning covers Baldwin or Mobile County. New business stays closed until 24 hours after the threat ends. AIUA binding rule Buy before storm season, not during it.

A named-storm deductible is separate from your normal deductible and is usually a percentage of insured value. Alabama Department of Insurance An insurer that adds a wind exclusion or a new or higher hurricane deductible at renewal must give 120 days' notice. Alabama rule 482-1-136-.05

Is wear and tear covered?

Insurers usually separate sudden storm damage from long-term wear. Rotted wood, rusted rods and old cracks are wear. That is why dated photos from before the storm matter. A wall that was sound last year and failed after a surge tells a different story from one that was already leaning.

  • Keep yearly photos and the last inspection report.
  • Keep invoices for earlier repairs.
  • Record low-water views when the toe and pilings show.

See the storm guide for the first steps after damage.

Do flood insurance discounts differ by city?

FEMA's Community Rating System (CRS) lowers flood premiums where a city or county does more than the minimum. The discount varies a lot across the coast.

The unincorporated county discount covers Fort Morgan, Bon Secour, Point Clear, Montrose, Lillian and Ono Island. FEMA CRS list Gulf Shores has been Class 10 since April 2023. The CRS discount applies to the flood policy on the house, not to the bulkhead.

How do flood maps affect my lot?

Every Baldwin County flood map panel has been effective since April 19, 2019. FEMA shows no new preliminary map for the county as of October 31, 2026. FEMA flood layer Orange Beach uses the Baldwin County map. FEMA Community Status Book

Coastal high hazard (VE) zones on the county map carry base flood elevations of 10 to 18 feet, most often 12 and 13. FEMA flood layer Look up your address at the FEMA Map Service Center, then confirm with the city or county. Orange Beach asks for a lowest floor at least two feet above base flood elevation. Orange Beach Code 42 The county adds one foot of freeboard. Baldwin County Floodplain Ordinance Gulf Shores asks for one foot above base flood elevation. Gulf Shores Code 7-92

The county layer also carries 35 lines marking the Limit of Moderate Wave Action, which separate Coastal A zones from ordinary A zones. FEMA flood layer A bulkhead does not change your flood zone, and a flood policy does not pay for it. The map still matters, because it sets your house's insurance price and elevation rules.

What should I ask my insurance agent?

  • Does any policy pay for the bulkhead, dock, boat lift or pilings, and under what causes of loss?
  • Is there a separate named-storm deductible, and what is the dollar amount on my home?
  • Does wind-driven rain or surge matter to which policy responds?
  • What proof of condition do you want before a loss?
  • How soon must I report damage, and in what form?

Write down the answers and the date. If the replies are vague, ask again in an email. Your records and the insurer's answers are the real coverage map for a wall.

How do I build a claim file?

  1. Dated photos before and after the storm.
  2. A written assessment from an engineer or marine contractor.
  3. The original permit and any approval letters.
  4. Every estimate and invoice, with scope described.
  5. Notes of each call with your insurer.

What should HOAs and condo boards know?

For condos, the association maintains common elements unless the declaration says otherwise. Alabama Uniform Condominium Act Costs of a limited common element can be charged to the units it serves if the declaration says so. Alabama Code 35-8A-315

Alabama does not require reserve studies or reserve funding for condos or HOAs in the sections reviewed. Ask whether your association has a bulkhead line item in its budget. A buyer of a resale condo who asks in writing within 14 days of signing can get the declaration and a certificate of assessments. Alabama Code 35-8A-409 Newer HOAs must provide budget and common-area records within 30 days of a written request. Alabama Code 35-20-13

The Homeowners' Association Act covers developments whose declaration was recorded on or after January 1, 2016, and older associations only if a majority of members opt in. It does not apply to condominiums. Alabama Code 35-20-3 See HOA seawall repair and condo seawall repair.

Are there loans or grants for a wall?

  • SBA disaster loans. A borrower can add funds for protection such as seawalls, limited to 20 percent of verified damage. Home loans are capped at $500,000 for real estate. SBA disaster loans
  • FEMA home repair aid. May cover a private dock only as safe access to a primary home, and never second homes. FEMA Individual Assistance
  • Strengthen Alabama Homes. Grants up to $10,000 for roof upgrades only. Alabama Department of Insurance

None of these is a seawall grant. Plan for a wall repair as a maintenance cost. See the cost guide.

Has federal aid helped after past storms?

Federal help for homeowners depends on the declaration. After Hurricane Sally, Baldwin County was covered for Individual and Households, Public Assistance and Hazard Mitigation programs. OpenFEMA Sally declaration Other recent storms were different.

Federal declarations for Baldwin County
StormWhat the declaration covered
Sally, 2020
Individual and Households, Public Assistance and Hazard Mitigation
Nate, 2017
Public Assistance and Hazard Mitigation, no Individual Assistance
Isaac, 2012
Public Assistance and Hazard Mitigation only
Zeta, 2020
Baldwin County was not on the major disaster list
Isaias, 2026
Emergency declaration EM-3656

Individual Assistance is the program that can reach homeowners. In several storms it never opened here, so a private bulkhead repair rests on insurance, savings or a loan. Pay attention to every deadline in your policy.

What should I do before hurricane season?

  1. Ask your agent in writing what your policies say about bulkheads, docks and lifts.
  2. Confirm your named-storm deductible and how it is calculated. Alabama Department of Insurance
  3. Buy or renew wind coverage early. The wind pool closes new business when a storm threatens. AIUA binding rule
  4. Photograph the wall at low water.
  5. Store the permit number, survey and contractor warranty with your policy.

Isaias shows how fast the window opens and shuts. AIUA reported its restrictions for that storm were lifted at 7:00 a.m. on October 12, 2026. AIUA binding rule

What should buyers check about the wall?

Alabama is a buyer-beware state for resale homes. The Real Estate Commission says no warranty comes with a used home. Alabama Real Estate Commission A general home inspection does not evaluate a bulkhead.

In Kidd v. Benson (2020), a Baldwin County case, a bluff stabilization on Fish River failed months after the sale and part of the bulkhead and boathouse fell into the river. The Alabama Supreme Court ruled for the sellers, because the buyers signed an as-is contract and did not inspect. Kidd v. Benson

When a seller must speak up

Alabama recognizes three exceptions to buyer beware. A seller must disclose known defects in three cases. One is a fiduciary relationship. Another is a material defect affecting health or safety that the buyer cannot readily see. The third is a material defect the buyer asks about directly. Kidd v. Benson

The buyers had asked by email if the stabilization was preventive, were told yes, and still lost. Kidd v. Benson Hire a marine contractor or engineer before closing and put questions to the seller in writing. See buying a waterfront home.

Where can I get help with a claim?

The coastal wind pool's eligibility line is (251) 943-4029. AIUA contact When you are ready to plan repairs, describe the wall and we will help you plan the next step through the project planner.
