Condo Seawall Repair in Orange Beach and Gulf Shores
Alabama puts common-element repairs on the association unless the declaration says otherwise, and Gulf-front condos face extra engineering.
When does a condo board need an engineer?
On the Gulf front, early. The Coastal Construction Line (CCL) is the state line that limits building on the beach. A hotel, condominium or multi-unit project on a parcel touching it must submit an environmental impact and natural hazards study. It must also submit a beach and dune enhancement plan. ADEM rule 335-8-2-.08
Orange Beach asks for a licensed engineer letter certifying that a Gulf-front wall is required. It also asks for an alternatives analysis and an adjacent-property impact analysis. Orange Beach Code 30-189
Alabama also bars most new walls on the Gulf beach itself. A wall is allowed only landward of the line, to protect an existing or previously permitted structure, with no feasible alternative. ADEM rule 335-8-2-.08(4)
Who pays for the wall?
Unless the declaration says otherwise, the association maintains, repairs and replaces common elements, and each owner handles the unit. Code of Alabama 35-8A-307
Assessments must be levied at least annually on an adopted budget. Past-due amounts can bear interest up to 18 percent a year. If the declaration says so, a limited common element is charged only to the units it serves. Code of Alabama 35-8A-315
Read the declaration for "limited common element" language before drafting a special assessment. It decides who pays.
What should we tell residents and buyers?
Resale buyers can ask in writing, within 14 days of signing, for the declaration, budget and an assessment certificate. The association has 15 days to deliver. Code of Alabama 35-8A-409
- Post the engineer report and the permit list in plain language.
- Explain which permits are pending, and which agencies decide them.
- Say what the flood policy does not cover. NFIP policy form
Gulf-front condos should read the Gulf-front guide. Back-bay condos follow the standard permit stack.
Keep the next review in view.
Ask about a maintenance plan to keep records up to date and arrange a sensible schedule for future checks.
Common questions
Does the state require a condo reserve study?
Check your declaration and budget for any reserve rule, and ask your attorney. For HOAs under the Act, the records a member can request include reserve funds, if any. Code of Alabama 35-20-13
Can the board charge only units next to the wall?
If the declaration makes the wall a limited common element, Alabama allows charging only those units. Code of Alabama 35-8A-315
Does a Gulf-front condo need extra studies?
Yes. ADEM requires an environmental impact and natural hazards study and a dune plan for multi-unit projects on parcels at the line. ADEM rule 335-8-2-.08
Who permits a Gulf-front wall in Orange Beach?
The city runs the state coastal program there, as do Gulf Shores and the Baldwin County Commission. ADEM coastal permitting
When do beach rules limit the work season?
Sea turtle nesting runs from May through October, and Gulf-front and first-tier lots may affect nests. USFWS Alabama field office
Can the board hire a contractor without a license check?
It should not. Verify the Alabama license and number on the bid. Code of Alabama 34-8-6
What do new owners and sellers get to see?
A resale buyer can ask in writing within 14 days of signing for the declaration, bylaws, budget, a certificate of assessments and any lawsuits. The association must deliver within 15 days. Code of Alabama 35-8A-409
That means a pending bulkhead assessment will surface in a sale. Boards that publish their plan early avoid surprises at closing.
Remember who pays. Unless the declaration says otherwise, the association maintains common elements. Code of Alabama 35-8A-307
Why is a Gulf-front condo wall different?
On Gulf beaches, a bulkhead or retaining wall is not permissible seaward of the Coastal Construction Line (CCL). Landward of it, a wall needs a protected structure and no feasible alternative. ADEM rule 335-8-2-.08(4)
ADEM's 2026 fee for a hardened erosion control structure on beaches and dunes is $2,545. ADEM Fee Schedule B
Older forms may print lower fees. ADEM Form 328 still shows $700. ADEM Form 328 Confirm with the city before budgeting. See the Gulf-front guide.
