Buying Waterfront in Orange Beach: Check the Bulkhead
Alabama gives resale buyers few protections, so the bulkhead has to be checked before you sign, not after you close.
How do I find the bulkhead history?
Start with permits. In Orange Beach, permits issued after 2018 can be searched by address or parcel in the city portal. Orange Beach permit portal In unincorporated Baldwin County, older permits and newer ones sit on two different sites, and the county will search if you email the address. What does the buyer-beware rule mean for my deal?

There are three exceptions: a fiduciary relationship, a material defect affecting health or safety that you cannot readily see, and a defect you ask about directly. Kidd v. Benson exceptions
Kidd v. Benson is the warning. Fish River buyers emailed to ask whether bluff stabilization was a problem or preventive. The sellers said preventive. The bluff, bulkhead and boathouse later collapsed. The buyers had not inspected, and the as-is clause defeated their fraud claims. Kidd v. Benson, the "preventive" answer
Ask in writing, get the answer in writing and inspect the wall anyway.

What this check is based on
The questions cover signs shown in the City of Holmes Beach seawall manual (pages 5–13): soil loss, wall movement, open joints and damaged concrete.
What to ask for in a seawall condition report
Confirm the type of assessment and written report with the professional you choose, including the scope and delivery date. Ask for dated photos, findings, recommended repairs and a list of areas that could not be inspected.
Ask whether the assessment covers the wall panels, concrete cap, joints, supports and ground behind the wall. Buried anchors and underwater areas may need extra investigation. If you need a repair budget or an estimate of remaining life, discuss that before the visit.
Request report pricing. Confirm the scope, price and availability directly with the professional before relying on a visit or report date.
See the InterNACHI waterfront inspection standard for examples of what a visual inspection covers.

Common questions
